So you only want the solpart menu to show up if the user has edit rights to the page?

One question just to be sure: will this also make sure the second menu code isn't executed when the user doesn't have appropriate rights?

If I understand the question, the answer is yes, but whenever you use code, always test all scenarios to make sure it is working as you expect.
